4. Legal Bases for Processing (EEA/UK)
If you are in the European Economic Area ("EEA"), Switzerland, or the United Kingdom, we process personal data under one or more of the following legal bases:
- Contract: when processing is necessary to provide the Services you request, such as saving progress, delivering gameplay functionality, restoring entitlements, or operating requested features.
- Legitimate Interests: when processing is necessary for our legitimate interests, such as securing and improving the Services, preventing abuse, measuring performance, maintaining records, and supporting our operations, provided those interests are not overridden by your rights and interests.
- Consent: when consent is required or appropriate, including for certain non-essential cookies, SDKs, analytics, advertising, attribution, or similar technologies, depending on the Service and your jurisdiction.
- Legal Obligation: when processing is necessary to comply with legal, regulatory, accounting, tax, or law-enforcement obligations.
5. Cookies, Local Storage, SDKs, and Similar Technologies
We may use cookies, local storage, native SDKs, pixels, software development kits, and similar technologies to:
- remember preferences and maintain session integrity;
- save gameplay state and app settings;
- support notifications, sharing, purchases, and app-review features;
- measure gameplay activity, service usage, app health, and performance; and
- measure advertising performance, subject to applicable law and platform settings.
Some of these technologies are necessary for the Services to function. Others, particularly analytics, attribution, and advertising-related technologies, may be optional or subject to consent requirements depending on your location and the Service you use.
You may be able to control some of these technologies through browser settings, device settings, platform privacy controls, and any consent tools or privacy choices we make available.
6. Analytics, Advertising, Purchases, and Platform Services
Depending on the Service and platform, we may use the following categories of third-party services:
6.1 Analytics and Measurement
We may use analytics and measurement providers to help us understand gameplay behavior, app usage, performance, marketing attribution, and product effectiveness.
These providers may process event data, device and app metadata, identifiers, and related diagnostics.
6.2 Advertising and Monetization
If advertisements are enabled in a Service, we may use advertising, monetization, and mediation partners.
These providers may process ad-related data such as advertising identifiers, app and device information, ad requests, ad delivery events, impressions, clicks, rewards, placement data, fraud-prevention signals, and similar metrics, subject to applicable law, platform settings, and any consent choices you make available to us.
6.3 Purchases and Entitlements
We may use purchase, subscription, and entitlement service providers, along with platform purchase infrastructure, to manage in-app purchases, restore purchases, and determine entitlement status. App-store and payment providers may also process transaction and account-related information according to their own privacy practices.
6.4 Platform and Device Features
We may use platform or device services to support:
- app-store distribution and purchase flows;
- native sharing features;
- native in-app review prompts; and
- native local notifications.
7. How We Share Information
We may share information in the following circumstances:
- Service Providers and Processors: with vendors and contractors that help us operate the Services, such as analytics, attribution, advertising, purchase, hosting, infrastructure, support, notification, and related providers.
- Platform Providers: with app stores, operating-system vendors, payment providers, and similar third parties as needed to distribute the Services or process transactions.
- Legal Compliance and Protection: when we believe disclosure is necessary to comply with law, regulation, legal process, or lawful governmental requests, or to protect the rights, safety, and property of Infinite Emerge, our users, or others.
- Business Transfers: in connection with a merger, acquisition, reorganization, financing, sale of assets, or similar transaction.
- With Your Direction or Consent: when you ask us to share information or clearly consent to sharing.
Where we share personal information with service providers, processors, platform providers, or similar third parties acting on our behalf, we require them, where applicable, to protect that information using the same or equivalent level of care and protection described in this Privacy Policy.
We may also disclose aggregated, de-identified, or otherwise non-personal information that does not reasonably identify you.
8. International Data Transfers
We and our service providers may process and store information in the United States and other countries that may have data-protection laws different from those in your jurisdiction.
Where required by applicable law, we take steps designed to provide an appropriate level of protection for transferred personal data, such as relying on contractual safeguards, adequacy decisions, or other lawful transfer mechanisms.
9. Data Retention
We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain gameplay continuity, support purchases, keep appropriate business and legal records, resolve disputes, enforce agreements, and protect our rights.
Retention periods vary by category. For example:
- gameplay state, settings, notification state, app-review state, and similar locally stored data may remain on your browser or device until deleted, overwritten, or cleared by you or by the app;
- purchase and entitlement-related records may be retained by us and by app-store, platform, or payment providers for support, accounting, audit, fraud-prevention, and legal purposes;
- analytics, attribution, and ad-related records may be retained according to our operational needs and our providers' retention settings or policies; and
- support communications and legal/compliance records may be retained as needed for legitimate business and legal purposes.
In many cases, locally stored gameplay progress, settings, notification state, and similar device- or browser-stored data can be removed by clearing browser/app storage, resetting the app, or uninstalling the app. However, some records, such as transaction, entitlement, support, fraud-prevention, accounting, and legal-compliance records, may need to be retained even after a deletion request, including by third-party app-store, platform, or payment providers that independently maintain those records.
10. Data Security
We use administrative, technical, and organizational safeguards designed to protect information we process. However, no security measure is perfect, and we cannot guarantee absolute security.
11. Your Rights and Choices
Depending on where you live, you may have rights regarding your personal information, including the right to:
- request access to personal information we hold about you;
- request correction of inaccurate information;
- request deletion of certain information;
- object to or restrict certain processing;
- withdraw consent where processing is based on consent;
- request data portability where applicable; and
- lodge a complaint with your local data-protection authority where applicable.
You may also have choices regarding cookies, device permissions, mobile-advertising settings, app-tracking settings, push-notification permissions, and marketing communications.
Where processing is based on consent or where privacy controls are available, you may be able to withdraw consent or adjust tracking, advertising, cookies, and similar preferences through device settings, platform privacy settings, app-tracking settings, browser settings, or any consent tools we make available.
To exercise applicable privacy rights, contact us using the contact details below. We may need to verify your request before responding, as permitted by law.
12. California Privacy Rights
If you are a California resident, you may have rights under California law, including the right to know what personal information we collect, use, disclose, and retain; the right to request deletion; the right to request correction; and the right not to be discriminated against for exercising applicable privacy rights.
Infinite Emerge does not sell personal information for money. If any of our activities are considered "sharing" for cross-context behavioral advertising under applicable California law, California residents may have the right to opt out, and we will provide any legally required mechanism for doing so.
13. Children's Privacy
Our Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13 without legally sufficient authorization. If you believe a child under 13 has provided us with personal information, please contact us and we will take appropriate steps.
14. Third-Party Links and Services
The Services may contain links to third-party websites, stores, or services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing them with information.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will update the Effective Date above. Your continued use of the Services after an updated Privacy Policy becomes effective means you acknowledge the revised policy, to the extent permitted by law.
